Welcome to VESVIORA. VESVIORA is the brand and store name used by 佛山市星觅珠宝有限公司. The terms “we,” “us,” and “our” refer to 佛山市星觅珠宝有限公司, operating under the VESVIORA brand.
We operate this online store and website, including all related information, content, features, tools, products, and services, to provide you with a curated shopping experience (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced in them (collectively, the “Terms”), describe your rights and responsibilities when you access or use the Services.
Please read these Terms carefully. They contain important information about your legal rights, orders, payment, delivery, warranties, and limitations of liability.
By visiting, interacting with, or using the Services, you agree to these Terms and our Privacy Policy, available through the policy links on our website. If you do not agree, you should not access or use the Services.
Nothing in these Terms excludes, restricts, or modifies any consumer right, guarantee, warranty, remedy, or liability that cannot lawfully be excluded, restricted, or modified under applicable law.
SECTION 1 - ACCESS AND ACCOUNTS
By using the Services, you represent that you are at least the age of majority under the laws applicable to you, or that you are using the Services with the permission and supervision of a parent or legal guardian.
You may be asked to provide information such as your email address, billing details, payment details, and shipping information. You represent that all information you provide is accurate, current, and complete and that you have the right to provide it.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person without our prior written permission.
SECTION 2 - PRODUCTS
We make reasonable efforts to display and describe our products accurately. However, colors and appearance may vary depending on your device, screen settings, lighting, and photography.
Product descriptions, prices, availability, and specifications may be updated at any time. We reserve the right to discontinue products or limit quantities offered to any person, geographic region, or jurisdiction, subject to applicable law.
Measurements, weights, gemstone colors, plating finishes, and handmade details may vary slightly where stated on the relevant product page. Such normal variations do not affect any rights you may have if a product is defective, damaged, or materially different from its description.
SECTION 3 - ORDERS
When you submit an order, you make an offer to purchase the selected products. An automated order confirmation acknowledges receipt of your order but does not necessarily mean that the order has been accepted. We may accept or decline an order for legitimate reasons, including product unavailability, payment failure, suspected fraud, pricing errors, shipping restrictions, or legal and regulatory requirements.
Your order is accepted when we send confirmation that it has been accepted or dispatched, depending on the checkout process applicable to your order. Payment must be successfully authorized and processed before dispatch.
Please review your order carefully before submitting it. If you need to request a cancellation or correction, contact us promptly at cindy@vesviora.com. We cannot guarantee that an order can be changed or cancelled after processing has begun. This does not affect any cancellation, withdrawal, refund, replacement, or other mandatory right available under applicable law.
Returns and exchanges are governed by our Refund Policy, available through the policy links on our website.
Unless otherwise agreed by VESVIORA in writing, purchases made through our retail online store are for personal or household use and not for commercial resale. Wholesale, corporate gifting, and custom orders are subject to separate written terms agreed between you and VESVIORA.
SECTION 4 - PRICES, PAYMENT, TAXES, AND IMPORT CHARGES
Prices, discounts, and promotions may change without notice. The price charged will be the price displayed at checkout when the order is submitted, subject to the correction of genuine errors and applicable law.
Shipping charges and any taxes or import charges collected by us will be displayed at checkout where applicable. VESVIORA ships international orders on a Delivered Duty Paid (DDP) basis to the destinations available at checkout, as further described in our Shipping Policy.
Under DDP shipping, VESVIORA is responsible for the import duties, import taxes (including applicable import VAT or GST), and ordinary customs clearance, brokerage, or carrier disbursement fees required to import the order into the destination country. These amounts are included in the total shown at checkout or are paid by VESVIORA. Customers should not be required to pay additional import duties, import taxes, or ordinary customs clearance charges upon delivery.
You are responsible for providing accurate billing, payment, and account information and for using a payment method that you are authorized to use. Payments may be processed by Shopify or other third-party payment providers under their applicable terms.
If a customer refuses delivery, does not collect a shipment, or fails to provide information reasonably required for customs clearance and the package is returned to us, any refund will be handled under our Refund Policy and applicable law. Actual outbound shipping, return shipping, storage, redelivery, carrier, customs penalty, or handling charges caused by that failure and that we cannot recover may be deducted where legally permitted and clearly disclosed. Ordinary import duties and import taxes covered by our DDP commitment will not be charged to the customer.
SECTION 5 - SHIPPING AND DELIVERY
Orders are fulfilled and shipped from China unless a product page, checkout, or shipping notice states otherwise.
Processing estimates, delivery estimates, available destinations, and other shipping information are set out in our Shipping Policy and may also be displayed at checkout. Delivery times are estimates and are not guaranteed.
We are not responsible for delays caused by carriers, customs processing, inaccurate customer information, severe weather, public emergencies, or other events outside our reasonable control. If a material delay occurs, we will provide any notice, cancellation option, refund, or other remedy required by applicable law.
Risk of loss or damage passes to you when you, or a person designated by you other than the carrier, receives the products. An exception may apply if you independently arrange a carrier that we did not offer, or where applicable law provides otherwise.
You are responsible for providing a complete and accurate delivery address. Please contact us promptly if you discover an address error. We cannot guarantee that an address can be changed after an order has entered processing.
SECTION 6 - INTELLECTUAL PROPERTY
The Services, including our trademarks, brand elements, text, graphics, photographs, videos, audio, product content, and the design, selection, and arrangement of such material, are owned by or licensed to VESVIORA and are protected by applicable copyright, trademark, patent, and other intellectual property laws.
These Terms permit you to use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit material from the Services except as allowed by law or with our prior written consent.
Nothing in these Terms grants you any license or other right in intellectual property belonging to VESVIORA, Shopify, or any third party. Unauthorized use may violate applicable intellectual property laws.
The VESVIORA name, logo, product names, designs, and slogans are trademarks or brand assets of VESVIORA or its licensors and may not be used without prior written permission. Shopify’s name, logos, product names, and related marks belong to Shopify. Other marks belong to their respective owners.
SECTION 7 - OPTIONAL AND THIRD-PARTY TOOLS
The Services may provide access to tools or features operated by third parties. We do not control such third-party tools and provide access to them on an “as is” and “as available” basis, to the fullest extent permitted by law.
Your use of optional third-party tools is at your discretion and may be subject to the third party’s terms and privacy practices. Please review those terms before using the relevant tool.
New features, tools, and resources that we add to the Services will also be subject to these Terms unless stated otherwise.

Nothing in this section excludes liability that cannot lawfully be excluded.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
VESVIORA is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with VESVIORA. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and VESVIORA, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with VESVIORA.
SECTION 10 - PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy, available through the policy links on our website.
Because the Services are hosted by Shopify, Shopify processes certain personal information relating to your access to and use of the Services. You represent that you own or have permission to submit the Feedback, that it is accurate to the best of your knowledge, that you have disclosed any compensation or incentive connected with it, and that it does not violate another person’s rights or applicable law.
We may moderate or remove Feedback that we reasonably believe is unlawful, fraudulent, abusive, misleading, obscene, infringing, or otherwise violates these Terms. We are not required to keep Feedback confidential, pay compensation for it, or respond to it unless we have separately agreed otherwise.

The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates, or availability.
We may correct genuine errors and update information. If an error materially affects an order that you have already submitted, we will contact you and provide any choice, cancellation, refund, or other remedy required under applicable law. Corrections to website content do not reduce rights relating to an order that has already been accepted.

You may use the Services only for lawful purposes. You must not use the Services to:

An Agent may access or interact with the Services only where permitted by applicable law, these Terms, our technical instructions, and any robots exclusion or access-control measures. Agents must not conceal their automated nature, impersonate human behavior for deceptive purposes, circumvent CAPTCHAs or security measures, or continue accessing the Services after being instructed to stop.
We may use reasonable technical measures to limit or control automated access to protect customers, store security, inventory integrity, and the availability of the Services.

You may stop using the Services at any time. We may suspend or terminate access where reasonably necessary for security, fraud prevention, legal compliance, non-payment, or a material violation of these Terms.
Termination does not affect rights and obligations that arose before termination, including obligations relating to accepted orders, payments, refunds, returns, intellectual property, privacy, or provisions that by their nature should continue.
SECTION 16 - WARRANTIES AND STATUTORY RIGHTS
We do not guarantee that access to the website will always be uninterrupted, timely, secure, or error-free. Website information is provided for general information and should not be relied upon where professional advice is required.
To the fullest extent permitted by law, the website and optional digital features are provided on an “as is” and “as available” basis. This limitation does not apply to mandatory rights relating to products you purchase.
Products remain subject to all consumer guarantees, conformity requirements, product-liability rules, and other protections that cannot lawfully be waived. Nothing in these Terms excludes a remedy available because a product is defective, damaged, unsafe, not as described, or otherwise fails to meet a mandatory legal standard.
SECTION 17 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, VESVIORA and its directors, officers, employees, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential loss that was not reasonably foreseeable when the relevant contract was formed.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury where liability cannot be excluded, product liability that cannot be excluded, or any mandatory consumer right or remedy.
Where liability may lawfully be limited, our aggregate liability arising from a particular order will not exceed the total amount paid for that order, except where a higher amount is required by applicable law.
SECTION 18 - INDEMNIFICATION
To the extent permitted by law, you agree to indemnify VESVIORA against third-party claims, losses, and reasonable costs directly resulting from your unlawful use of the Services, your intentional infringement of another person’s rights, or your material breach of these Terms.
This section does not require a consumer to indemnify us for our own negligence, unlawful conduct, breach of contract, defective products, or matters for which liability cannot lawfully be shifted.
SECTION 19 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary. The remaining provisions will continue in effect.
SECTION 20 - WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce a right or provision does not constitute a waiver of that right or provision.
These Terms and the policies expressly incorporated into them constitute the agreement between you and us concerning use of the Services and purchases made through our retail online store, except for any separate written agreement applying to a wholesale, corporate, or custom order.
SECTION 21 - ASSIGNMENT
You may not transfer your rights or obligations under these Terms without our prior written consent, except where applicable law permits otherwise.
We may transfer our rights or obligations as part of a genuine business transfer, restructuring, or service arrangement, provided that the transfer does not reduce any mandatory rights you have. We will provide notice where required by law.

These Terms and any contract formed through the Services are governed by the laws of the People’s Republic of China, without excluding any mandatory consumer protection law that applies based on the customer’s country or place of residence.
You and VESVIORA should first attempt to resolve disputes by contacting cindy@vesviora.com. Subject to any right a consumer has to bring a claim in another competent forum under mandatory law, disputes that cannot be resolved informally will be submitted to the courts with competent jurisdiction in Foshan, Guangdong, China.
Nothing in this section deprives a consumer of any protection, remedy, or right to use a court or dispute-resolution process that cannot lawfully be waived.

Headings are provided for convenience only and do not affect the interpretation of these Terms.
SECTION 24 - CHANGES TO THESE TERMS
The current version of these Terms will be available on this page. We may update these Terms to reflect changes in our Services, business practices, legal obligations, or other legitimate reasons.
Material changes will be notified where required by applicable law. Unless applicable law requires otherwise, updated Terms apply prospectively from the stated effective date and do not retroactively reduce rights relating to an order already accepted.
Your continued use of the Services after updated Terms take effect constitutes acceptance of those changes to the extent permitted by law.
